Please take a minute to read the following: **NOTICE TO ALL BIDDERS** The high bidder is required to post with the Clerk a non-refundable deposit of 5 percent of the bid or $200, whichever is greater, at the time of sale, to be applied to the sale price when the remaining balance is paid. The remaining balance MUST BE PAID WITHIN 24 HOURS FROM THE TIME OF SALE OR THE DEPOSIT IS FORFEITED. NO EXCEPTIONS! The deposit & full amount can be paid by cash/cashier’s check/money order/ wire transfer. Tax certificates may be redeemed at any time up until the actual issuance of a Tax Deed by the Hernando County Clerk’s Office. If a tax certificate is redeemed, there will be no Tax Deed sale. All persons bidding on Tax Deeds are strongly urged to read Chapter 197 of the Florida Statutes and Chapter 12D-13 of the Florida Administrative Code.
Tax certificates may include abbreviated legal descriptions. In the event the holder of a tax certificate makes an application for a Tax Deed, the same legal description is used and advertised in the public notices. This is the legal description that goes on the Tax Deed if there is a Tax Deed sale. Hernando County attempts to use a legal description that identifies the subject parcel; however, all persons bidding on Tax Deeds are urged to verify the sufficiency and accuracy of any legal description prior to bidding. Properties sold at a Tax Deed sale remain subject to governmental liens. All persons bidding on properties at Tax Deed sales are urged to examine title prior to bidding. All Tax Deed Properties are sold “Buyer Beware.” If there is a Mobile Home on the property, transfer of the Mobile Home Title is the responsibility of the buyer.
The properties being sold may also be subject to the current year or unpaid property taxes and/or Government Liens. If you are the successful bidder at a Tax Deed sale, there is no guarantee that you will be able to convey good or marketable title to the property to someone else or that the legal description on the Tax Deed is sufficient. If there is any problem with the title or the legal description, the general remedy is to file a civil lawsuit to “quiet title.” The institution of a suit to quiet title may involve having to hire an attorney at your expense. HERNANDO COUNTY DOES NOT WARRANT TITLE CONVEYED BY TAX DEED.
