What is the date, time, and location of the next tax deed sale?
The tax deed sale is held by the Clerk of the Circuit Court in the BCC Chambers, 1st floor of the Government Center on the first Friday of each month (unless it falls on a holiday) and is open to the Public. The only exception to the Friday Sale dates is if one has been rescheduled. The date of the rescheduled sale will depend on the availability of the BCC Chambers. The property is auctioned to the highest bidder: Purchase price is payable at the Clerk''s Office upon completion of the sale, payable by cashier''s check, money order or cash. If full payment is not received upon completion of the sale, a non refundable deposit of $200.00 or 5% of purchace price, whichever is greater, is required. The remaining balance MUST be received within 24 hours of sale. There ARE NO EXCEPTIONS! No personal checks are accepted for the bid amount.
Is there a minimum deposit to bid at the sale?
Yes, the minimum deposit is $200.00 or 5% of the purchase price, whichever is greater. The remaining balance of the purchase price (including recording fees and documentary stamp taxes) must be received within 24 hours of the sale. If not, the entire cash deposit is forfeited.
When and where do you advertise the sale?
The property is advertised for four consecutive weeks prior to the Tax Deed Sale. Currently we are advertising in the Hernando Section of the Tampa Bay Times.
Can you send me a "sale list" of properties that will be available?
The "Sale List" can be viewed on the Clerk's Website at www.hernandoclerk.com - Click on Tax Deed and Foreclosure Sales button on the home page.
Are tax deed sale records available online?
Tax Deed Sale Records/Images are available on the Clerk's website under the Records menu/Tax Deeds. Here are direct links to "Tax Deed Sale List and "Tax Deed Files."
What form of payment do you accept?
Purchase price is payable at the Clerk's Office upon completion of the sale, payable by cashier's check, money order or cash. If full payment is not received upon completion of the sale, a non refundable cash deposit of $200.00 or 5% whichever is greater is required. The remaining balance must be received within 24 hours of the sale. If the purchaser does not return within the 24 hour period, the entire cash deposit is forfeited.
Can I bid without attending?
No, the Tax Deed Sale is an auction (public outcry), open to the public and property is sold to the highest bidder. You MUST be present at the sale in order to bid.
Does the opening bid include all Taxes and Liens on the property?
No, the property being sold may be subject to current year or unpaid Property Taxes and/or Government Liens.
If I end up with a property, who handles the quiet title process?
Tax Deeds are not clear titles. Quiet title suits to clear the title of properties are Civil lawsuits and are not handled by the Tax Deed Clerk. Information on this procedure and costs would be available from an Attorney that handles these types of legal proceedings.
What happens to the properties that are not sold at the auction?
A property that does not sell at the Tax Deed Sale is struck off and sold to the Certificateholder. If the Certificateholder is Hernando County, and there are no bids, then the property is placed on the "List of Lands Available for Taxes." After 90 (ninety) days from the sale date, anyone can purchase property off the "List of Lands Available for Taxes."
What happens to liens that are against the property when sold at tax deed sale?
Governmental liens and judgments survive the issuance of the Tax Deed and may be fully or partially satisfied with any overbid monies from the sale. Liens of government units, not satisfied in full, survive the issuance of the Tax Deed. Should you have any questions concerning other types of liens and judgments which survive the Tax Deed Sale, consult an attorney. We cannot advise you.
If there is a Mobile Home on the property, how do I obtain the Mobile Home title?
If there is a Mobile Home on the property, transfer of the Mobile Home Title is the reponsibility of the buyer. The properties being sold may also be subject to current year or unpaid property taxes and/or Government Liens. The buyer would need to contact the Tax Collector's office regarding the Mobile Home Title.
Overbid surplus funds (owners and lienholders) - how do we claim?
For Tax Deed Sales held prior to 7/1/11, if there remains, after the sale, excess overbid funds, after all monies have been held for two years, and no claims have been made, on the first day of the following quarter the Clerk/Comptroller remits such unclaimed funds to the Board of County Commissioners. Once turned over to the Board of County Commissioners, the monies are forever barred.

Any claims submitted during the two year claim period should be sent directly to the Clerk's Office at: Hernando County Clerk, Recording/Tax Deed Division, Room # 362, 20 North Main Street, Brooksville, Florida 34601.

To claim funds that are held by the Clerk during the 2 year claim period, an "Affidavit of Claim" form can be found on the Clerk's web page at www.hernandoclerk.com. Select the "Records" tab from the title bar across the top. From the drop down menu, select Tax Deeds and then forms.

For Tax Deed Sales held 7/1/11 or after, if there remains, after the sale, excess overbid funds and they have not been claimed within one year after they become payable, the funds are considered "unclaimed property" and disposed of in the manner prescribed in Ch. 717.117, Florida Statutes. Surplus funds which have been held by the Clerk for 1 full year as of December 31st of each year are transferred to the Department of State in May of the following calendar year.
