Felony
A felony is any criminal offense that is punishable under Florida laws, or that would be punishable if committed in Florida, by death or imprisonment
in a state correctional facility.
Felony charges include, but are not limited to: murder, manslaughter, rape, burglary, grand theft, aggravated battery, child abuse, forgery, possession
and/or sale of drugs, fleeing to elude law enforcement, and leaving the scene of an accident with serious bodily injury or death. Felonies are classified for purposes of sentencing into the following categories:
- Capital Felony - Punishable by death or life imprisonment without eligibility for parole
- Life Felony - Punishable by a term of life imprisonment and by a fine not to exceed $15,000
- Felony of the first degree - Punishable by a term of imprisonment not to exceed 30 years and by a fine not to exceed $10,000
- Felony of the second degree - Punishable by a term of imprisonment not to exceed 15 years and by a fine not to exceed $10,000
- Felony of the third degree - Punishable by a term of imprisonment not to exceed 5 years and by a fine not to exceed $5,000
Currently, this department keeps records for three circuit court divisions, including one circuit judge who specializes in matters related to drug court and mental health court.
Customers requiring information regarding a felony case may visit the Felony Department in Room 136. Public computers are available to our customers and provide free access to
court records held by the Hernando County Clerk of Circuit Court.

Misdemeanor/Criminal Traffic
A misdemeanor is any offense which has a maximum penalty of less than one year in the county jail.
Misdemeanor charges include, but are not limited to: retail theft, possession of marijuana, domestic battery, driving under the influence and driving while license is suspended.
Misdemeanor offenses also include payable civil infractions such as boating, hunting, fishing and tobacco violations. Misdemeanors are classified for purposes of sentencing into the following categories:
- A First Degree Misdemeanor is punishable by a term of imprisonment not to exceed 1 year in the county jail and by a fine not to exceed $1,000.
- A Second Degree Misdemeanor is punishable by a term of imprisonment not to exceed 60 days in
the county jail and by a fine not to exceed $500.
Currently, this department keeps records for two county court divisions which also specialize in matters related to domestic violence court.
Customers requiring information regarding a misdemeanor case may visit the Misdemeanor Department in Room 134. Public computers are available to our customers and
provide free access to court records held by the Hernando County Clerk of Circuit Court.
